These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Extreme Game Truck has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Extreme Game Truck shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

In addition to the terms above and  below, the Customer agrees to supervise the use of game truck and further agrees that if any item is damaged that he/she will reimburse Extreme Game Truck for the full price to fix the damage and/or the full replacement value of the rented item. Upon placing a deposit for an event booking, customer agrees to all terms and conditions herein, and has had all questions answered to full satisfaction and understanding.Delivery/Operation: Customer agrees to provide adequate space for driver to park truck and trailer safely in an area that is free from any potential damage to equipment. If adequate and safe parking is not ready when driver arrives, there will be no adjustment to event time; no refunds or rainchecks will be given for time that driver has to wait for parking to be made available.
General Rules for Safe Operation:  Trailer must be parked on a smooth, clean and level surface. The trailer may NOT be parked on mud, sand or rough surfaces such as rocks, brick, glass, or any jagged objects. Equipment MUST BE properly parked and level prior to use. Once Game Trailer is parked, it MUST NOT be moved during the event. Truck must be connected to trailer at all times during event. Additional Safety Rules: Weapons of Any Kind in or Near Game Trailer are Strictly PROHIBITED. Always have a sober adult present, who has reviewed and understands both this contract and the rules for the Game Trailer. Never allow the users to be unsupervised in or around the trailer. Never allow more users than the maximum number of users per age group as directed by Game Attendant. Food, drinks and confetti-type material (glitter, silly string, etc.) is not permitted in game trailer. Do not allow horseplay on, in, or around the equipment. Always follow the directions of the Game Attendant. Failure to follow rules may result in fees being charged to your credit card to clean, repair or replace equipment. By signing this agreement you authorize this company to charge your card for any cleaning or repair or replacement fees.WiFi/Online Gaming: Extreme Game Truck will make every effort to connect to the internet for online gaming. Customer agrees that there may be times or areas where internet connectivity is substandard or not available at all.  The game coach will do his/her best to connect as many consoles as possible. If there is no connectivity, customer will not be charged. Customer will only be charged if one or more gaming consoles is able to connect to the internet to play online video games.  
Additional Terms of Service: Extreme Game Truck is not responsible for bad weather, disruption of electrical service and/or unfavorable conditions that may arise and no charges or fees will be reimbursed as a result. Absolutely no silly string or similar items, such as, but not limited to, food, drinks, confetti, foam or trash, in or around the game truck at any time. Customer will be responsible for the full replacement value of the equipment and/or assessed up to a $250.00 cleaning fee. Customer agrees not to operate the equipment in a manner contrary to this contract and the rules of use. If Customer uses the equipment in a manner contrary to the contract and rules of use and direction of the Game Attendant and any equipment is damaged, Customer agrees to pay the cost of repair or full replacement value of any damaged equipment. Customer further agrees to be liable for any loss of said equipment by reason of fire, theft, or any other cause. Customer may also be responsible for any loss suffered as a result of company not being able to service other parties or events. Hold Harmless Provisions: Customer agrees to indemnify and hold Extreme Game Truck harmless from any and all claim, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Customer hereby releases and holds harmless Extreme Game Truck from injuries or damages incurred as a result of the use of the equipment. Extreme Game Truck cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Customer also agrees to indemnify and hold harmless Extreme Game Truck from any loss, damage, theft or destruction of the equipment during the term of the event and any extensions thereof.
Payment and/or Credit Card Charge Authorization: Customer agrees to pay for service in full no less than 7 days prior to the start time of the event and will in no way dispute any charges related to this service. Any event scheduled less than 7 days from the date and time of the event are subject to be paid in full at time of booking. By signing this agreement, customer acknowledges and agrees that any charges made by credit/debit card will be honored/paid in full and customer will in no way dispute any charges.Cancellation Policy: Please know that for all events, the 50% deposit is not refundable and unless the event is cancelled by the customer 7 days or more prior to the date and time of the event, are subject to a charge equal to 100% of the balance owed with no refunds. Breach/Indemnity/Arbitration: In the event that Customer breaches any of the terms of this contract, that Customer will pay for all consequential damages and further indemnify Extreme Game Truck for all costs incurred by Extreme Game Truck incurred in enforcing the terms of the contract or in defending any claim or lawsuit arising out of the operation of said equipment, including the amount of any judgment, attorney’s fees and costs. If Extreme Game Truck determines, within its own discretion, that Customer has failed, in any way, to observe or comply with the conditions of this agreement, Extreme Game Truck may exercise any of the following remedies: termination of this agreement; reenter property and retake the equipment; declare any outstanding fees and charges immediately due and payable and initiate whatever legal proceedings necessary to recover said equipment or monies; and/or pursue any additional remedies available it by law. If a conflict arises, Extreme Game Truck and Customer will abide by the California state laws and forgo filing a lawsuit to solve the dispute.
BY SIGNING THIS AGREEMENT, CUSTOMER ACKNOWLEDGES THAT HE/SHE IS THE RESPONSIBLE PARTY AND HAS FULL AUTHORIZATION TO USE THE CREDIT/DEBIT CARD USED TO SECURE THIS BOOKING. CUSTOMER HAS COMPLETELY READ AND UNDERSTANDS THIS CONTRACT AND ANY AND ALL ACCOMPANIED ADDENDUM(S). CUSTOMER HAS BEEN FULLY INFORMED BY EXTREME GAME TRUCK PERSONNEL AS TO THE SAFE OPERATION FOR THE AFFOREMENTIONED EQUIPMENT AND ALL QUESTIONS HAVE BEEN ANSWERED TO SATISFACTION.
